Consumer Consent & SMS Messaging

How EarnedStars collects consumer consent, what messages consumers receive, and how to opt out at any time.

What is EarnedStars?

EarnedStars is a business tool used by local contractors and home-service companies (plumbers, electricians, HVAC technicians, landscapers, and similar trades) to send automated SMS feedback requests to their customers after a completed job.

EarnedStars does not send unsolicited messages. Every message is sent only to customers of the subscribing business โ€” people who have already done business with that company and have provided their mobile number.

How Consumer Consent Is Obtained

Before any SMS message is sent, the consumer must provide express consent at the point of service. The subscribing business (the contractor or service provider) is responsible for obtaining this consent during the customer relationship โ€” typically at the time of scheduling or job completion.

The consent disclosure presented to consumers reads:

"[Business Name] uses EarnedStars to send a text message after your service asking for your feedback. You'll receive 1 message per job, plus 1 follow-up reminder if you don't respond. Message and data rates may apply. You can reply STOP at any time to opt out, or HELP for assistance. By providing your mobile number, you agree to receive these messages."

Consent is collected verbally or in writing by the service provider at the time of the customer interaction. No consumer is messaged without first providing their mobile number to the business and being informed that they will receive a feedback text.

Consent is specific to the subscribing business (e.g., "Smith Plumbing"). EarnedStars does not share or re-use consumer phone numbers across different businesses. Opting out stops messages from that specific business only.

What Messages Consumers Receive

After a job is completed, a consumer will receive the following types of messages:

  1. Initial feedback request โ€” sent once after the job, asking the consumer to rate their experience 1โ€“5 and including direct links to leave a public review on the platforms the business uses (such as Google, Facebook, or Yelp).
  2. Follow-up response โ€” sent once in reply to the consumer's rating, including review links regardless of rating. For lower ratings, an additional note is included that the business owner will follow up โ€” review links are always provided to every customer.
  3. One reminder โ€” sent once approximately 24 hours later if the consumer does not reply, with review links.

Message frequency: approximately 2โ€“3 messages per completed job. No ongoing marketing messages are sent. Messages are only triggered by a completed service job.

All messages identify the sending business by name and include opt-out instructions.

"Awesome, thank you! ๐Ÿ™ If you'd share that publicly, it really helps us: [Review Links]. Reply STOP to opt out."

Message 2b โ€” Response to Lower Rating (1โ€“3)

"Thanks for the honest feedback! [Owner First Name] will reach out personally to make things right. We'd still genuinely welcome your public review: [Review Links]. Reply STOP to opt out."

Message 3 โ€” 24-Hour Reminder (if no reply)

"Quick note from [Business Name] โ€” we'd love your feedback on your recent service, and a public review helps us a lot: [Review Links]. Reply STOP to opt out. Msg & data rates may apply."

How to Opt Out

Consumers can opt out of receiving further messages at any time by replying to any EarnedStars message with one of the following keywords:

Opt-outs are honored immediately and permanently. Once you opt out, no further messages will be sent to your number from that business via EarnedStars, unless you affirmatively opt back in.

Quiet Hours

EarnedStars will not send messages before 8:00 AM or after 9:00 PM in the recipient's local time zone. Messages triggered outside of these hours are queued and delivered the following morning.

Message & Data Rates

Standard message and data rates may apply depending on your mobile carrier plan. EarnedStars does not charge consumers for messages. Contact your mobile carrier for details about your plan's SMS rates.

EarnedStars's handling of consumer data is described in our Privacy Policy. Consumer phone numbers collected by subscribing businesses are used solely to deliver the feedback messages described on this page and are not shared with third parties or used for marketing purposes.
